1.1 JacquesHermes.com is the online exposure and sales store through the Internet. Before you enter the online store and browse our website, we invite you to consult the following terms and conditions, which are specifically applied for the use of the online shop located in www.JacquesHermes.com.

1.2 The Store belongs to “ZIKOUDIS P. VASILEIOS” company, based at 3, Anatolikis Thrakis, P.C. 544 53, Thessaloniki.

1.3 Main and foremost concern of our company is the disclosure of the terms that governing the rights and obligations and in general the operation of the online store www.JacquesHermes.com, with the intention to inform the visitors/users of the webpage, to enlighten them regarding their rights and obligations and their best possible serving during their access to the services of the Store and especially the search and shopping at the Store.

1.4 Make sure that you agree to the following terms and conditions because further use and browsing in the online Store implies your explicit and unconditional consent and agreement.

2.1 the notification of some of your personal data is a necessary requirement for the initiation of a transaction between us. When you place an order, we will ask you for your full name, the address where the goods will be delivered, your phone number (or any other phone number that you want us to use for your better service), and your e-mail address.

The above prerequisites data are used from the Store for two reasons:
- to  process the order,
- to satisfy the specific requirements of its customers regarding the serviced and the products available through the Store,

2.2 The Store, strictly following the principles of personal data protection set out by the relevant laws and international conventions will not use them illegally and without your previous consent. The Store will not disclose, publish, sell, exchange in any way your personal data and information entrusted to us. In exception, your personal data can be disclosed by the company, always complying with the statutory procedures when this is required for compliance with the relevant provisions of the Law and only to the Competent Authorities.

2.3 You can change in any time your personal data that have been known to us or/and restrict or cancel the use of some of this data.

2.4 The management and protection of the visitor/user’s personal data is subject to the terms of the present section as well as the relevant provisions of the Greek law (l. 2472/1997) for the protection of the individual and the protection of sensitive personal data, as it has been supplemented by the Decisions of the President of the Personal Data Committee, the PD 207/2998 and 79/2000 and art. 8 of l.2819/2000 as well as l. 2274/1999 of the European law (directives 95/46/EK and 97/66/EK). The present terms are stated taking in mind both the rapid development in technology and especially the Internet, and the existing – albeit not developed – grid of legal regulations regarding these issues. In this context any potential relevant arrangement, will be an arrangement of this section. In any case, the Store reserves the right to change the terms of personal data protection after the briefing of the customers/users and within the given or potential legal framework.

2.5 Thus said, if a visitor/user does not comply with the terms of personal data protection, provided hereafter, is obliged not to use the services of the Store.

3.1 The Store provides its visitors/users the ability to purchase its products through e-commerce applications, according to the special terms that it expresses and ensuring for the protection of the personal data submitted for the use of these services.
In the cases where the e-commerce applications are made between the users and the Store, the Store is obliged to comply with the Ministerial Decision Z1-496/2000 for long distance sales and the provisions of l.2251/1994 for the Consumer’s Protection as well as MD Z1-629 (GG B’720/30.05.2005). So, the Store is obliged to inform its potential customers regarding: a) the substantial characteristics of the products it offers, b) the price, c) the quantity and the shipping cost, d) the VAT if it is not included in the price, e) the way of payment, f) the delivery way, g) the duration of the offer or the price and h) the right of withdrawal.

3.2 Access to the pages/services of the Store does not carry any additional cost, other than the current pricing regime for general access in the Internet, as it has been formed by the responsible supplier and it is paid to them only.

3.3 For using the services of the Store’s e-commerce, the visitor/user is asked the following data: full name, address, telephone number, e-mail, and city. The above data are required for issuing the relevant tax documents. These data under no circumstances are to be disclosed to any third parties, unless they fall into the exceptions specifically mentioned in the present contract.

4.1 The Store is committed to the quality, the competence and accuracy of the information listed in its webpage, both regarding the accurate data displayed and the supplied by the e-commerce services, subject to any technical or printing errors that cannot be predicted or have occurred unintentionally or any downtime of the site due to force majeure.

4.2 All mentioned prices include VAT (23%). These prices regard the quantities available in our warehouses, while the Store reserves the right to adjust the prices at any given time.

5.1 The Store makes every effort in displaying with the greatest accuracy the available products, while there are larger images of the products to highlight the details. Nevertheless, because the final display depends on the user’s/customer’s screen, there is the possibility of differentiation from the actual image of the product, differentiation that the Store is not liable for.

5.2 By the term “Initial Price” the Store lists on the garments for sale in every category the average retail cost that presumably each of them is sold in the European and International market (in stores and multi stores, e-commerce stores etc) after simple research. Consequently, the listed “Initial Prices” are merely indicative and in no way binding, and the Store holds no responsibility for any variations that may be traced in the prices of the sold garments in their various selling points.

6.1 PAYPAL is the most popular and safe payment system worldwide. This payment system intermediates between the salesman and the buyer in order for the contracting parties to know only the necessary data to fulfill the payment. 

6.2 DEPOSIT into a bank account. After the fulfillment of the order one of our associates will contact you for the details of your deposit and verification of your order.

7.1 After the submission of your order and within one (1) working day, our trained stuff will contact you by telephone and via e-mail for the acceptance of your order the the shipping details. The contract shall be deemed to be formed and the commitments arising from this start to run from the time of receipt by the customer of the electronic acknowledgement – confirmation of the order sent by the provider. If your order is submitted until 11:00 in the morning (Monday-Friday) our communication will take place the same day.

7.2 If communication with you is not possible, the order remains pending for 5 consecutive working days, after which your order is cancelled automatically.

8.1 Shipping ways
The Store is cooperating with SPEEDEX Courier and the Greek Post Office for the shipment of the products. To facilitate all, please inform the Store regarding any specific details of the acceptance place (floor number, office number, etc) where this is required.

8.2 Shipping cost
The shipping cost is set at the amount of 6 euro throughout Greece, except for inaccessible areas. Inaccessible areas are those outside the city network of the cooperating courier company. The charge for those areas varies and you will be notified accordingly before the shipment of your order. For purchases above 100 euro shipment is free of charge.

8.3 Delivery dates and times
Acceptance of your order is done within nine (9) working days at the latest of the date of confirmation (between 9:00 – 17:00) from the courier company to the address you have specified in your order form.

8.4 Delivery of products
All package delivery is done at your space.

8.5 Availability
For all products listed in the Store’s catalogues is clear indications regarding the availability of our warehouse. So you can easily find out before you place your order, which of our products are available in our warehouse and immediately deliverable and which are not directly available but we are committed to their delivery time.

8.6 If, for reasons of force majeure (i.e. bad weather conditions, strikes, etc.), it is not possible for us to deliver the products within the specific time, we will inform you via e-mail, in order for you to tell us if you wish, under the circumstances, the completion of your order.

9.1 If the electronic order has been complete, but the product has not been shipped yet, you can call to +302310467055 or via e-mail and one of our associates will take care of the cancellation of your order.

9.2 After the receipt of the product, be advised of paragraph 10 Withdraw and Product Returns and call +302310467055, one of our associates will take care of the details.

You have the right to return the products you purchased and ask for their replacement:

10.1 In every case where with proven fault of the Store there were wrong products or products of poor and defective quality sold (there was a mistake in receipt of the order, the pricing, the shipping, damages during transportation, sold in bad packaging etc.).

10.2 In all of these cases, the customer has the choice to either not accept the product from the beginning, or, after the receipt, to return the product within 10 days of the delivery date. In any case, the products must be returned in the same condition they were received, along with the sales receipt. If not returned within 10 days, the Store might not accept any return and replacement.

10.3 Also, according to article 4 of L. 2251/94,
Α. You have the right to return the products you purchased, without penalty and with no obligation to tell us the reason why you want the return of the products, within 14 working days from the receipt date. In this case the Store is obliged to return the amounts paid by the customer without charge within 30 days (article 4 par. 10 l. 2251/1994, as replaced by par. 11 article 4 l. 3587/2007, GG A 152/10.07.2007).
Β. Returns are being accepted only if the products you wish to return are in same condition in which you received them, that is without having been unsealed or their packaging been violated, along with the sales receipt or the sales invoice.
Γ. To avoid your own discomfort, it is best advised to check carefully at the time of receipt of your order the condition of the products sold and the unharmed of their packaging, in order to detect any obvious defects (i.e. broken merchandise, wrong type, etc.).
Δ. If the visitor/consumer exercises the right to withdraw, must notify this in written or by any other durable mean available in which he has access to. Therefore, if you wish to return the products you have purchased you must inform us via e-mail to support@jacqueshermes.com In case of product return the refund will be completed within 30 days from the date we receive the products.

11.1 The Store provides its visitors/users access to member services, upon acceptance of the terms of use and completion of the entering process of the potential member’s data.

11.2 As soon as the visitor/user completes the admissions procedure the Store has set, he will receive confirmation of a personal access code (password) and user name which he has set.

11.3 All members remain solely responsible for all actions done under their personal access code, user name and account in general. All members agree to notify immediately the Store for any unauthorized use of their account and any actual or/and potential security breach. Also, all members are solely responsible for the careful use of their account and the typical log out of their account after every use.

11.4 The Store does not hold responsibility for any damage caused by the inability of the members to respect and follow this clause.

12.1 Advertising: the Store gives the possibility to the users to choose the information about new products available in the market and any other potential offers, payment arrangements etc, by sending advertising – informational messages at their e-mail address. The Store will not use the above service improperly. The possibility of stop receiving these messages is given to the users at any time.

Without the usage of cookies it would have been impossible for us to offer you important services such as: personal settings, storing items in your cart between visits, etc. Cookies are alphanumeric files transferred to your hard drives through your internet in order to provide services such as those mentioned above. All transactions made through the Store are governed by International and European Law that regulate issues regarding e-commerce as well as the Law on Consumer Protection (L. 2251/1994), as amended and in effect regulating issues regarding long distance sales.

12.7 Liability Limitation
The Store, employees, or other representatives, hold no responsibility, under any circumstances, for any consequential, incidental, indirect, special damages or expenses or penalties, including, but not limited to, lost profit, interruption of business, information or data loss, or customer loss, property loss or damage, and any third party claims arising out of or in connection with the use, copy or presentation of this website or its contents or any other connected website, regardless if the Store had been advised, knew or should have known this possibility.

12.8 Intellectual Property and Brand

All website design as well as its context, including text, graphics, images etc., the selection and its arrangements, constitute intellectual property of the Store and thereof protected by the relevant provisions of Greek Law, European Law and International Treaties. Therefore, nothing in the content of this website can be wholly or partially sold, copied, modified, reproduced, republished or “loaded”, transmitted or distributed in any way.
